Plaintiff was then brought to the 23rd precinct where he voluntarily submitted a DNA sample, proving that he never had contact with the weapon allegedly found in the apartment. Still, Plaintiff was charged with possession of the weapon and marijuana. As a result of the arrest, Plaintiff was charged with violating his parole, charges later dismissed.
