The dog owners started a physical conflict which resulted in Plaintiff’s injuries on his face and left hand. Dog owners then called the police, falsely claiming that Plaintiff attacked them. They continued to punch and kick Plaintiff, leading to further bruising, contusions, scrapes, and cuts on his arms and body. By the time P.O. Brian Porzelt and Brittany Waldon arrived at the scene, Plaintiff had two black eyes, his left hand was bleeding, and he had numerous cuts and bruises all over his body, arms, and legs. They could not understand what Plaintiff was saying but did not request a translator. They searched Plaintiff’s person and clothing without his consent and seized his phone as he was trying to call his brother-in-law to seek help in speaking with the officers. The EMTs performed basic treatment for Plaintiff’s injuries at the scene but were prevented by the officers at the scene from taking Plaintiff to the hospital for further evaluation. Plaintiff’s brother-in-law arrived and attempted to help file a complaint against the dog owners but the officers refused. P.O. Gina Fabrizio said that she did not want to hear anything from Plaintiff, and then ordered P.O Porzelt to handcuff Plaintiff and place him under arrest, which caused Plaintiff significant pain, given that he had just been attacked. They prevented the brother-in-law from translating for Plaintiff while he was being arrested. \n\nAt the precinct, each officer Plaintiff spoke to refused to file a complaint against the dog owners. Plaintiff reached out to his local elected representatives and the news media, and the precinct invited him back and informed Plaintiff that his complaint should have been taken at the scene of the incident. Plaintiff explained to P.O. at the precinct, with a translator, what happened to him and was assured that his complaint is processed and an officer is already put on the case. However, nothing was done to investigate the incident or prosecute the dog owners.
