Erickson Ramirez approached plaintiff and asked for his name and then asked plaintiff to put his hands up, without announcing himself as a police officer.  Then, P.O. Ramirez grabbed plaintiff and threw him on a gate, leaned over his shoulder, and threatened him.  Plaintiff asked if Ramirez had a badge, Ramirez responded that he did not, and plaintiff asserted that it was an illegal stop and frisk.  P.O. Ramirez started to manhandle plaintiff, trying to throw him to the ground.  P.O. Ramirez called his partner for backup, and they both jumped on plaintiff as plaintiff was having an anxiety attack.  One wrapped the hood of plaintiff's sweater around plaintiff's neck, choking him to the point where he could hardly breathe, and the other was forcing his weight on plaintiff.  Plaintiff continuously screamed for help and said that he could not breathe, but the officers ignored him.  The officers got plaintiff to the ground and hit him in the temple with a walkie talkie and then slammed his head into the concrete.  More backup arrived and someone put their knee on the back of plaintiff's neck, pinning his face into the concrete.  Then they handcuffed plaintiff so tightly that he could not feel his wrists. When plaintiff LG accompanied the friends and entered a subway station. One friend ran away upon the sight of an officer. Plaintiff LG who was afraid of the police due to her experience as a young African American and the other friends ran shortly after. Police officers stopped plaintiff LG and arrested him/her and the friends. At the precinct, police officers searched plaintiff and placed him/her in a cell. Plaintiff LG's mother arrived but officers refused to allow her to see or talk with LG. Corporation Counsel declined to prosecute the case and the charges were dismissed. Since then, LG has continued to suffer panic attacks in the presence of NYPD. Not everyone in this group was friends. The Plaintiffs were walking LG, NG, and DA in the area of the Atlantic Terminal toward Fort Greene Park, the area where LG lived. At approximately 10PM, in the vicinity of the Atlantic Terminal one of the children in the large group struck a bystander pedestrian in the face as the group was moving toward Fort Greene Park. Neither LG nor NG assisted in this in any way. As the pedestrian lay bleeding on the ground, LG approached the pedestrian and asked whether he needed assistance. At this point, many members of their group ran away. Out of fear, plaintiffs ran toward Fort Greene Park. About 30 minutes later, NYPD PO Joel Paulino, Sgt. Camacho & John and Jane Doe (1-5) stopped and unlawfully detained LG, NG, and DA. At this moment, the police had the injured pedestrian pick the assailant out of an impromptu lineup. The pedestrian did not identify LG, NG, or DA, but the plaintiffs were nonetheless arrested on gang assault charges. The were handcuffed and transported to the 88th precinct.\n\nLG and NG were not given the opportunity to communicate with their parents, and an officer did not let Plaintiff see her infant child. The infant plaintiffs were shackled excessively in a way that hurt them and transported to a detention center by Defendants Paulino, Camacho, and Jane and John Doe (1-5). The detention center did not let the children interact with their guardians. At 7AM, the children were released and transported to Brooklyn family court. Before their release, the infants were detained for at least 20 hours. A court official told Plaintiff Johnson that the bystander pedestrian who had been struck had not identified LG, or NG. The pedestrian was not sure that NG or any of the children had hit him. The Defendant Police Officers then removed the Plaintiff from the vehicle and searched both without legal justification and then arrested the Plaintiff and charged him with possession of marijuana. The Defendants then handcuffed the Plaintiff and put him roughly into the police vehicle, injuring the Plaintiff's back in the process.\n\nThe Defendant Police Officers refused to seek medical treatment for the Plaintiff and they turned away EMS personnel who had arrived at the precinct to treat the Plaintiff.  The Defendant Police Officers falsely informed employees of the Kings County District Attorney's office that they had observed the Plaintiff in possession of marijuana and forwarded false evidence in support of the allegations. The Plaintiff was eventually taken to Brooklyn Central Booking where he informed the medical staff of his injuries. The Plaintiff was then taken to a hospital for treatment and then back to central booking.
