Plaintiff had come to a hospital where his son had been admitted as a gunshot victim.  Plaintiff was not an immediate threat to himself before being tased, nor was he actively resisting custody.  The discharge of the taser knocked the plaintiff to the ground forcefully.  He struck his wrist and sustained scrapes and bruises.  The plaintiff was handcuffed on the ground.  Later the police transported the plaintiff to a precinct, where he was detained for several hours.  As a result of being tased, the plaintiff sustained a serious injury to his left wrist, causing significant pain and discomfort. The Plaintiff cooperated with the officers and provided the requested documentation. In response, the officers instructed the Plaintiff to step out of his car with his hands raised. The Plaintiff was then questioned about the sale of his car and was accused of criminal possession of a forged instrument without any legal cause. Even though the Plaintiff provided documentation from the car dealer proving that the sale and license plate were valid, the Defendants proceeded to arrest him. During the arrest and while in custody, Officer Basnight harassed and mocked the Plaintiff. For example, Officer Basnight told Plaintiff, after looking over the documents, that if he cannot afford to register his car, he should not have a car. \n\nWhile in custody, Sergeant “John” Martinez interrogated the Plaintiff about drug and gun activity in the neighborhood. Although the Plaintiff clarified that he had no information, Sergeant Martinez continued questioning him and told him that he would get him out of trouble if he provided any information. The Plaintiff remained in custody because he had no information to provide. After being released from custody, the Plaintiff returned with the seller to prove that the sale and license were valid. Officer Basnight dismissed them and threatened the seller. A criminal proceeding was initiated against the Plaintiff, but the case was ultimately dismissed.
