Upon arrival, he sat on his stoop and conversed with friends. Shortly thereafter, defendant police officers Pearce Martinez and John Doe #1 were called to the deli to respond to an alleged robbery. They approached the plaintiff, stating they needed to arrest him for the theft of a six-pack of beer from Howard Deli. The plaintiff asserted he had paid for the beer and that the surveillance video from Howard Deli would confirm his purchase. The officers instructed the plaintiff to stand and approach them, to which he asked if they had reviewed the surveillance footage.\n\nWithout warning or provocation, the officers forcibly handcuffed the plaintiff. While escorting him to their police vehicle, one officer punched the plaintiff between his neck and shoulder and kneed him in the rib cage. At the 81st precinct, the plaintiff experienced breathing difficulties due to his injuries and was taken to Interfaith Medical Center, where he was diagnosed with contused ribs and a right shoulder tear. He remained in the hospital overnight, handcuffed to the bed, and was prohibited by the officers from informing medical personnel about the cause of his injuries.\n\nThe next morning, defendant officer John Doe #2 returned the plaintiff to the 81st precinct and placed him in a dark room. There, he was interrogated by defendant officers Lim Taejin and Lt. Wilson, to which he did not respond. Defendant NYPD Officer Jonathan Martinez (Shield # 953059) responded \"Suck my dick, get out of my face nigger\". Plaintiff followed Defendant Martinez out fo the building for the purpose of obtaining his name and shield number. The Plaintiff was then arrested with excessive force by Defendant NYPD Sergeant Taejin Lim, Lieutenant James Gebbia, Sergeant Joseph Edmund, Officer James McSherry, Officer Joseph Sferrazza, Officer Kristin Coscia, Officer Carlos Ponce, Officer Raymond Hernandez, Officer Joel Rodriguez and Officer Alan Ye. Defendant Martinez punched the plaintiff two or three times in the face, a second officer punched the Plaintiff two or three times in the body, a third defendant attempted to place the Plaintiff in a headlock. The remaining officer witnessed the above beating but failed to intervene. At the precinct, the Defendant officer filed false information with the District Attorney's Office causing False Criminal Charges against the Plaintiff to be filed. After 24 hours in custody the Plaintiff was released on his own recognizance.
