Plaintiff Pinder, who was just 17 years old with no criminal record, had just finished playing a basketball game and was on his way home, when he was surrounded by the defendant officers and arrested, then taken to the 79th precinct and interrogated about a firearm the officers claimed to have found.   Plaintiff Ballard was standing next to his parked car when he was surrounded by the defendant officers, searched, arrested, and taken to the 79th precinct, where he, too, was extensively questioned about a gun that was allegedly found.  Despite no illegal contraband found on or near either plaintiff, they were falsely accused of possessing a firearm.  Plaintiff Pinder was charged with weapon possession and released without bail after 45 hours of arrest, with all charges later dismissed.
