While in custody, the Plaintiff was unlawfully deprived of meaningful access to food, water, bathroom, soap and other hygiene products, and other necessities for an extended period of time, and subjected to filthy, crowded, and unsanitary conditions of confinement. Their request to lose the tight handcuff was ignored and confiscated their insulin and did not let them administer it resulting in missing a dose of it. Members of the NYPD surrounded the protestors upon their arrival. The first plaintiff in this action, a Black nonbinary person, was pushed off the sidewalk. NYPD officers utilized barricades to trap plaintiff and other protestors. Two unidentified officers threw plaintiff to the ground. Six officers then surrounded them as two officers beat and kneeled on plaintiff, putting pressure on their back. NYPD officers then forcefully removed plaintiff's glasses and jacket as another officer struck plaintiff's head. Plaintiff was thrown to the ground with so much force that they struggled to breath. Six officers dragged plaintiff across the sidewalk and injured their knee. At this point, onlookers began to record, and officers attempted to block onlookers from doing so as they continued to assault plaintiff. One officer then placed plaintiff in extremely tight zip-tie handcuffs which cut off circulation to plaintiff's hands resulting in significant pain. Officers placed plaintiff in a van to take them to the precinct. Eventually, plaintiff could no longer feel their hands. After communicating as much to the officers, it took them twenty minutes to remove the cuffs. By that point, the process of removal caused further pain and injury. The officers refused plaintiff's request to wear masks to protect against COVID and proceeded to mock and mis-gender plaintiff for the entirety of the ride to the precinct. At the precinct, officers denied plaintiff access to counsel or any phone use while in custody. Officers also deprived plaintiff of meaningful access to food, water, bathroom, soap, and basic hygiene. NYPD unnecessarily exposed plaintiff to risk of COVID by subjecting them to unsanitary conditions of confinement. The case against plaintiff was ultimately dismissed, but they still require medical and psychological treatment following these events. \n\nThe second plaintiff in this matter attended the same protest. Three unidentified NYPD officers used a metal barricade to shove and strike plaintiff as she stood on the public sidewalk. PO Katherine Tejeda was plaintiff's arresting officer and filed false complaints against plaintiff based on information provided by PO John and  Jane Does 1-2. Plaintiff was released with a Desk Appearance Ticket signed by Sergeant Scott Haldeman on the morning of June 5, 2020. Plaintiff was charged with Unlawful Assembly. Nikkas pushed Plaintiff into the street and ordered another unknown officer to arrest Plaintiff. The plaintiff was then arrested.\nOn July 30th, Plaintiff was walking through Foley Square and was stopped by Inspector Elias J. Nikkas. He asked Plaintiff \"how was the beach\", a reference to an Instagram post on Plaintiff's account. Nikkas' remark reminded Plaintiff of NYPD surveillance.\nOn August 11, 2020, Plaintiff was in Washington Square Park when officer Captain O’Hare approached and said, \"time to go Nicky\", and walked on.\nOn September 29, 2020, Plaintiff was protesting outside Governor Andrew Cuomo's office at 633 Third Avenue, New York, NY 10017.  Police Officer John Doe 3 asked protestors to leave at 11:00pm. He put Plaintiff in a headlock with his baton and dragged her to the ground. Four other officers including Police Officer John Doe 4,5,6, jumped onto Plaintiff and held her down as Police Officer John Doe  3 choked her.  Police Officers John Doe 4 and John Doe 5 put their knees into Plaintiffs back and leg to hold her down for several minutes. They arrested and detained Plaintiff for over 24 hours.\nOn October 5, 2020, Plaintiff was attending a protest at Seaport. Plaintiff was on the sidewalk when Lieutenant Michele Irizarry dragged Plaintiff off the sidewalk by the hair, then arrested Plaintiff. Earlier the same officer had asked, \"Hi Nicolle, having a good night?\" and upon questioning followed with, \"Everyone knows your fucking name.\" \nOn October 17, 2020, Plaintiff attended a protest at Washington Square Park. Police Officer Captain Julio Delgado was smoking a cigar. Plaintiff asked why the officer was smoking a cigar against code, and he ordered another officer to arrest Plaintiff. several officers rather harassed and threatened Plaintiff until she left the protest.\nOn October 26, 2020, Plaintiff was protesting in Time Square when Officers John Doe 8, 9, 10, and 11 pulled Plaintiff to the ground and forced her to her knees. Police officer Yu Kian and Police Officer John Doe 8 dragged Plaintiff and arrested her. In transport the officers referred to her Instagram videos of protests and at the precinct desk, they referred to her again by name.\nOn November 17, Plaintiff was attending a protest in Brooklyn Borough Hall when Police Officer Edward Casaceli approached and referred to her by name. He said, \"Every knows your fucking name; your picture is on all of our desks.\" \nOn December 11, 2020, Plaintiff was attending a protest near the UN building and helping a friend who was injured. Police Officers John Doe 12 and 13 ran and tackled Plaintiff to the ground, zip tied and arrested her. The NYPD then released Plaintiff's full name and address to the New York Post, including false claims that Plaintiff interfered with emergency responders following a car plowing through the crowd. Defendant NYPD Lieutenant Eric Konoski told Plaintiff that she could not cross the street to leave the area, despite Plaintiff explanation that she lived two blocks away. Defendant Konoski then needlessly, brutally, and otherwise unreasonably grabbed Plaintiff by her left time after Plaintiff continued to peacefully speak to him and Defendant continued to twist Plaintiff's arm behind her back, causing it to pop. Plaintiff expressed her pain, but Defendant Konoski ignored this and continued to twist Plaintiff's arm further behind her back in response. Three unidentified officers arrived and placed zip ties on Plaintiff's left arm in an overtight manner and attempted to do so on the right arm but were unable to fit it around her wrist. Defendant officers grabbed Plaintiff's hair to move her to the ground, kneed her in the stomach, and hit Plaintiff's right hand multiple times with a baton. Defendants then slammed Plaintiff face-first onto the roadway, and at least one Defendant officer obstructed Plaintiff's breathing while she was on the ground by kneeling on her back and neck, causing Plaintiff to fear for her life. Defendant officers, while Plaintiff was on the ground, moved the zip tie around her right wrist and left Plaintiff on the ground for a few minuets before two Defendant officers moved her to 136th and Brook Avenue to sit with the other detainees. Defendant officers refused to loosen the zip ties on Plaintiff nor provide her medical treatment for her arm despite her request. Instead, defendant officers knocked Plaintiff's feet out from under her, forcing her into a sitting position. The fellow detainees called for medical help for Plaintiff, and EMT personnel arrived and informed the Defendant officers to remove the zip ties, with which the defendant officers complied, but this was after Plaintiff had been in zip ties for approximately one hour. Defendant officers eventually released Plaintiff to be taken in the ambulance, not giving her any ticket or summons. Plaintiff asked the Defendant officers where his bike was and was told that they would take care of it, but Plaintiff never saw the bike again. A NYPD member also removed the shirt that Plaintiff had been using to cover his face during the protest and placed it in his backpack. After Plaintiff was rear-cuffed on the sidewalk for some time, a NYPD member asked something similar to \"Whose are those?\" in reference to the arrestees, to which another officer responded something resembling \"we need more bodies\" to fill the bus. Defendant John or Jane Doe 4 assigned Defendant Ryan Costello to process the arrests of Plaintiff and three others despite the fact that Costello was unable to identify and receive information from a fellow officer who observed the pre-arrest conduct. A NYPD member cut the straps of of Plaintiff's backpack, taking it from him before loading him onto a bus with other arrestees. Plaintiff was forced to wait in a long line of arrestees among arriving at the precinct, where the handcuffs were still placed to tightly on Plaintiff, and Defendant Costello ignored Plaintiff's requests to loosen the handcuffs. Eventually, when Plaintiff's hand began turning blue, Defendant Costello tried to unlock the handcuffs but could not do so, leading to a third NYPD officer to use needle-nose pliers and a key to remove them. Defendant Costello then put plastic flex-cuffs on Plaintiff. Once inside the precinct, Plaintiff was searched, photographed, and moved among rooms and cells until his release around 5:00 am. During this time, Defendant Costello and other NYPD members forced Plaintiff into close proximity with NYPD members and other arrestees, many of whom were not wearing masks. Plaintiff also eventually was returned his backpack, but it was damaged. At least one of Does 11-13 replaced plaintiff’s metal handcuffs with extremely tight plastic handcuffs, along with an additional NYPD Doe Officer. Plaintiff was brought to Police headquarters. The next day PO Hussain issued plaintiff a Desk Appearance Ticket with Arrest Number K20619506 and released plaintiff from custody. P.O.s pushed both to the ground; two pushed Chowdhury face down into the ground and zip-tied her arms overly tight. Three officers took Ahmed to the ground after one kicked the back of his knees. Ahmed’s face struck the ground; his arms were forced into a painful position behind him and his wrists overly tightly cuffed with metal handcuffs. This caused him severe pain; he asked they be loosened but was ignored. \n\nChowdhury and Ahmed were placed in two separate buses and waited for two to three hours, before being taken to wait in a line outside of One Police Plaza for an hour. Chowdhury asked her zip ties be loosened, but was told to wait until she went inside. Once inside, both Chowdhury and Ahmed’s restraints were removed and they were imprisoned. Chowdhury was later removed from her cell and issued a summons by an Officer Lebron for failure to comply; Ahmed was removed and issued two summonses for failure to comply and for disorderly conduct. When they went to court later, no record of their summonses could be found. One or more officers sat or kneeled on top of Mr. Rios and handcuffed him with flex-cuffs with excessive tightness on the ground, impeding Mr. Rios’s breathing. Another officer stepped intentionally on Mr. Rios’s face, breaking his eyeglasses. On the same date plaintiff Ross was riding a bicycle roughly one hour after the 11:00 p.m. curfew then in effect in Manhattan. A defendant officer abruptly grabbed her handlebars throwing Ross to the street and fracturing her foot in two places.\nOn June 2, plaintiff Bredder and Zurkuhlen were each arrested by defendants employing excessive force. Defendants beat Ms. Zurkuhlen on the arms and upper body with batons, and he tackled her to the ground. Each plaintiff's hands were bound with flex-cuffs in an excessively tight manner.\nOn June 3,  plaintiff Salazar was rammed by two NYPD bicycles, began recording the police activity with her cell phone until an officer threw her against a wall, told her she was under arrest, and placed her in excessively tight flex-cuffs. On the same date plaintiff Bredder was arrested again. Defendant NYPD officers punched\nBredder on the chin and affixed excessively tight flex-cuffs. On the same date, plaintiff Pluchino was arrested. NYPD officer applied flex-cuffs to Pluchino’s wrists with extreme tightness, causing significant pain. \nOn June 4, 2020 plaintiff Sow was pepper sprayed by defendants during a protest at Mott haven. Defendants affixed overly tight flex-cuffs, and ignored Sow's hands turning purple and his pleas for medical attention. On the same date, plaintiff Durkee was grabbed and pushed to the ground by defendant officers. Plaintiff was transported to Brooklyn Central Booking where he was arraigned there on 10 criminal charges, including 3 felonies. He filed a report against his roommate and the detective assigned to the report stated that \"the precinct had already taken a position on the matter.\" Plaintiff also filed a complaint with the NYPD Internal Affairs Bureau, which failed to materially investigate his claim or speak with the officers from the earlier altercation to substantiate Plaintiff's account. On November 9, 2015, the assistant district attorney stated to the court that he contacted Officer Vasco and that the \"complaining witness\" lacked credibility.
