As this assault took place, defendant officers Deposito, Melrose, Herrera, Doyle, Ardolino, and Walsh arrived upon the scene. These defendants had the opportunity yet did not intervene to stop the assault upon the Plaintiff. Instead, these defendants assisted in taking the Plaintiff into custody.\n\nAt the precinct, the Police Defendants falsely informed members of the Kings County District Attorney's Office that they had observed Plaintiff\ncommitting various crimes. The Plaintiff was taken from the police precinct to Brooklyn Central Booking. PO Hughes was the driver, who also pursued the Plaintiff while in the car. It was only when the Officers caught the Plaintiff, that they told him they were NYPD and put him in handcuffs. They did not tell the Plaintiff why he was under arrest. Sgt. Demonda approved of the arrest, despite the manufactured evidence against the Plaintiff. Later, the Plaintiff was told he was arrested for alleged possession of a firearm, which he did not possess. PO Herrera signed a criminal complaint that stated the Defendants had observed the Plaintiff urinating on a public sidewalk and also dropped his gun to the ground. Both allegations were false. While they found no contraband, POs did find a laminated fire guard card with Plaintiff's name and date of birth. When asked Plaintiff explained he was issued that card after taking and passing the fire guard test. Without explanation, POs placed Plaintiff in their car and took him to the 73rd Precinct, where Plaintiff was processed and taken to Central Booking. Approximately 20 hours later Plaintiff was brought before a judge and learned for the first time he was being charged with possession of a forged instrument. After a year of court appearances Plaintiff's case was dismissed and sealed.
