Plaintiff was moving to a safer part of the train to avoid a threatening passenger when Defendant officers, in plain clothes, surrounded, grabbed, and forcibly removed him from the train. During the arrest, Plaintiff was pushed, pulled, pepper sprayed, and excessively handcuffed, causing physical injuries. Despite complying, Plaintiff was repeatedly pepper sprayed even after being restrained.\n\nPlaintiff was transported to Interfaith Medical Center for eye injuries caused by the excessive use of pepper spray, where his legs were shackled to his handcuffs. After receiving treatment, he was taken to an NYPD precinct, where he repeatedly asked what he was being arrested for, but Defendants refused to provide an answer. Plaintiff was then transported to Kings County Central Booking. Defendant officers falsely accused him of Obstructing Governmental Administration and provided misleading information to the DA’s Office. After spending 48 hours in custody, Plaintiff was arraigned and released.
