Plaintiff grabbed the door to keep from falling face first to the ground, and he was screaming that he was not resisting and was exiting the vehicle. Defendant tased Plaintiff twice. Defendants punched and kicked plaintiff, and they took his sneakers off and threw them across the street. Defendants then hit Plaintiff with a baton multiple times on his legs and back causing him to lose consciousness from the beating. Plaintiff woke up with his hands handcuffed behind his back, feet cuffed, and laying face-down in the back of a long 8-seater-type van bleeding from his mouth and nose. Defendant officers transported Plaintiff to Police Service Area 2, and dragged him with his hands and feet cuffed. Plaintiff remained there handcuffed, laying with his stomach on the floor, for two hours while waiting for an ambulance. Paramedics struggled to remove Plaintiff’s handcuffs because of how tightly they were placed around Plaintiff’s wrists. Plaintiff was transported to Brookdale Hospital for medical treatment. Defendants then transported Plaintiff back to Police Service Area 2, where he remained for two hours before being transferred to Central Booking.  While in custody, defendants provided the DA with false, misleading and incomplete information that plaintiff committed a crime. When officers searched the trunk, plaintiff took issue as they could not see the search and officers could plant contraband. Plaintiff and the other men were then removed from the car, searched and placed under arrest. Plaintiff's cuffs were excessively tight and he requested they be loosened but was denied. Plaintiff was then taken to the precinct, where he was told he ewas arrested because officers had found a fraudulent card in the trunk. Plaintiff remained in excessively tight cuffs for an additional 35 minutes before htey were removed. He was taken to central booking and held for other 24 hours before he was released.
