Plaintiff complied and walked off the train and proceeded to walk up the steps of the station. Plaintiff lost his step and fell down 12 steps. Defendants moved out of the way as Plaintiff fell. Plaintiff landed on his chest and was then handcuffed and arrested for two counts of assault in the second degree. Plaintiff was taken to the precinct and held for five hours. Defendants filed false reports of the event to the District Attorney. Defendant Batista lied about her claim stating Plaintiff had pushed her down the stairs, causing her to suffer injuries to her wrist, head, neck and back. Defendant Colangelo stated plaintiff resisted arrest by flailing his arms and caused him injuries to his knee and ankle. Plaintiff spent 11 months in jail as a result of the claims and forced to appear in court multiple times.
