Kevin Weber, PO Joel Feliz, PO Jose Gomez, PO Sergey Pogosyan, and PO Anthony Rivera approached and falsely accused Plaintiff of crimes before violently grabbing Plaintiff's head and body, motivated in part by racial prejudice. POs were informed multiple times by Plaintiff and bystanders that Plaintiff is a paraplegic who cannot get out of a car on his own. At no time did Plaintiff refuse to exit the vehicle, only mentioning that he required assistance. Regardless, POs grabbed Plaintiff violently by his disabled leg and neck and ripped him from the car. \n\nPlaintiff was then illegally searched, including in intimate areas, without legal justification. POs then slammed Plaintiff on a car before violently handcuffing Plaintiff's wrists with excessively tight cuffs. The cuffs caused Plaintiff to experience bruising, swelling, pain, and discomfort. POs, taking inappropriate advantage of Plaintiff's disability, then allowed Plaintiff to fall backward to the ground while handcuffed with no ability to catch himself. Plaintiff's cell phone had started recorded and continued recording as POs took possession of it. Plaintiff's cell phone documented POs mocking and ridiculing Plaintiff in their police car as they fabricated charges against him. Plaintiff was wrongfully imprisoned for approximately three hours before his release. Plaintiff was also maliciously prosecuted but all charges were terminated due to lack of probable cause. Plaintiff was attacked directly in front of Defendants PO Rodriguez and PO Chowdhury. Even as Defendants intervened, the attackers refused to relent and Plaintiff continued to get punched and kneed. Defendants accused the group as a whole of fighting, even though Plaintiff was being jumped. \n\nShortly after, one of the attackers grabbed an aluminum bat and charged at Defendant Rodriguez - who was standing in front of Plaintiff. Plaintiff bolted down the street and was chased by the attackers. Defendant Rodriguez followed the group of attackers at a leisurely walking pace and Defendant Chowdhury did nothing. As the attackers caught up to Plaintiff, he was in fear for his life as the Defendant police officers were well behind them. Plaintiff stabbed one of the attackers in the stomach. Defendant Rodriguez did not detain any of the attackers or attempt to secure the bat in their possession, even after witnessing the criminal acts. Instead, Defendants told the attackers to return to their house. When other officers arrived at the scene, Officer Rodriguez told Plaintiff to shut up and falsely insisted to arriving officers that Plaintiff was the blameworthy culprit. Defendants Almontepichardo, Rinaldo, Liberatore, Gomera, Marrone, and Rivera, among others, responded to the scene and participated with Defendants Rodriguez and Chowdhury in an investigation of what had happened.
