Plaintiff opened the door and spoke with defendants, answering their questions. Defendants asked Plaintiff for certain documents to aid their investigation of a complaint. Plaintiff advised officers she would retrieve the documents, would be right back and closed the door. Defendants broke down plaintiff's door and entered her home. Defendants verbally harassed, threatened, assaulted, battered, threw to the ground, and sprayed plaintiff with chemical agents. Defendants forcibly removed Plaintiff from her residence, arrested and charged her with crimes they knew she had not committed. Defendants failed to decontaminate Plaintiff in a timely manner. Following arrest, Defendants transported Plaintiff to the 113th Precinct, where she was placed in a holding cell for several hours. Plaintiff was transported to Queens General Hospital where she remained in police custody and handcuffed to her hospital bed for more than three days. Upon Plaintiff's hospital discharge, she was returned to the Precinct for four hours, then transported to Central Booking to await arraignment. Plaintiff spent five days in police custody. Plaintiff, a professional tow-truck driver, received a call to tow a car. Plaintiff took the car to the incident address. At the address, the owner of the vehicle refused payment for the tow. Plaintiff called the police. Defendants Keegan, Pena and Rodriguez arrived at the scene. Plaintiff provided the officers his license upon request. Plaintiff had meanwhile contacted the City’s Directed Accident Response Program for guidance. DARP informed plaintiff a sergeant was being sent to the scene. Plaintiff relayed this information to the NYPD officer defendants. Officers, angered that a sergeant had been called to the scene, arrested plaintiff. Plaintiff was eventually taken to the precinct. At the precinct, officers falsely informed the Queens County DA they observed plaintiff commit Obstruction of Governmental Administration and Disorderly Conduct. Plaintiff was subsequently taken to Queens Central Booking. Plaintiff was arraigned in Queens County Criminal Court.
