The clerk gave Plaintiff the purchased items and then was tackled by defendant officers. The officers pushed Plaintiff's limbs and dragged her face about the floor of the store. Defendant officers arrested Plaintiff, patted her down and tightly restrained her with unreasonably tight handcuffs and shackles. Plaintiff did not commit any crime or violate the law in any way. Defendants did not recover any drugs, weapons or illegal contrabad from Plaintiff. Plaintiff was unlawfully arrested and tightly handcuffed without probable cause or legal reason. Plaintiff was taken to the emergency room at Kings County Hospital where she was examined and treated for her injuries. Then Plaintiff was taken against her will to Kings County Central Bookings where she was fingerprinted, photographed and put in a holding cell. While in custody, the officers gave the Kings County District Attorney's Office with false and misleading information that Plaintiff had committed a crime. Plaintiff was arraigned on April 15, 2023 in Kings County Criminal Court and charged with crimes. On July 26, 2023, all the charges were dismissed and sealed.
