On arrival, a female that did not order the Uber jumped into Plaintiff's car and sat next to Plaintiff while crying. Plaintiff explained the female needed to leave the vehicle. The female became angry, pulled Plaintiff's cellphone out of its charger, exited, and threw the cell phone on the ground. The female also damaged the side mirror of Plaintiff's vehicle. When Plaintiff exited to retrieve his phone the female shoved him. Plaintiff filed a report with Uber. \n\nUnknown to Plaintiff, the female filed a false police report alleging Plaintiff assaulted her. Approximately one month later Det. Elvis Montalvo told Plaintiff to come to the precinct. Plaintiff did so on or about October 27, 2017 and was detained for several hours based on the false allegation, which POs knew was false because the female did not suffer or provide evidence of any injury. POs instead arrested Plaintiff based on their policy of imprisoning black men on false criminal charges for the sole purpose of giving them a criminal record.
