The demonstration was orderly and calm, however more police started to arrive to the protest and by 5:25 PM there were fifty police officers including all named defendants, Inspector Dowling, Deputy Inspector Hillery, PO Cascio, PO Cirikiovich, PO Dottavio, PO Johnson, PO Monestine, PO Mosquera, PO Olivares, and PO Singh. At about 5:27 PM, the PO's made an inaudible annoucement over a loudspeaker as Bensmaine noticed other protestors continue to make their way toward 47th street where the officers were located. At 5:27 PM, Bensmaine was in at the crosswalk at 47th street and 7th avenue where he waited for people in front to move out of his way, so he decided to take some photographs of the protest. Bensmaine alleges he was suddenly tackled by at least five of the defendant officers, who then piled on top of him and showed his face into the concrete. Eventually some officers got off of him and Bensmaine attempted to gather himself off the ground and retrieve his credit cards that were spread out on the street when the officer directly on top of him used his baton to push Bensmaine further into the concrete. Several officers crowded around Bensmaine while this was happening without intervening, which also made it difficult for other protestors to see what the POs were doing to Bensmaine. Bensmaine alleges he was violently and tightly zipped tied, then had the zip ties removed only for handcuffs to be tightly placed on his wrists instead. Plaintiff urinated on herself. Defendants then grabbed and twisted Plaintiff's arms and placed excessively tight handcuffs on her wrist. Defendant Officers then rushed at Plaintiff's daughter with their firearms drawn, yanked her off her bed and onto the floor, and wrenched her arms behind her black placing excessively tight handcuffs on her wrist as well. While Plaintiff and her daughter lay in their nightclothes and underwear on the floor, Defendant Officers walked around the apartment and eventually allowed Plaintiff and her daughter to sit in their living room. Defendant Officers continuously ignored Plaintiff and her daughter's concerns, questions, and complaints about her injuries. After more complaints of wanting to be dressed, one female Defendant officer finally allowed them to take turns and get dressed. Defendant Officers did not have any reasonable basis to use any degree of force. Plaintiff received medical treatment at a hospital. Those Defendant Officers who did not touch Plaintiff witnessed these acts of force and failed to intervene (though this is not an official cause of action). The search of the apartment did not result in any finding of controlled substances, contraband, or weapons. Defendant Officers Hillery, Fago, Rivera, Fried, Brooks, Hernandez, Meigs, Sanches, and Sposito initiated and falsely and maliciously told the Richmond County DA's office that Plaintiff and her daughter committed various crimes by stating, among other things, that they were in possession of an amount of marijuana. RCDA declined to prosecute Plaintiff's daughter and she was released from Central Booking without any charges filed against her, while Plaintiff was arraigned. Defendant Officer Hillery and Fago obtained an unlawful search warrant by recklessly, deliberately, and inadequately conducting an investigation, and/or purposely misrepresenting facts to a court official. As a result of Plaintiff's arraignment and charges filed against her, she was wrongfully terminated from her place of employment.
