Soon after, multiple unmarked police vehicles arrived at the location, opened the door of the vehicle, and asked plaintiff to confirm his identity, which he did. Police officers grab plaintiff by his neck, shoulder and arms and dragged him out of his back seat, without asking him to go out. He was arrested and brought to the precinct. All requests for medical treatment plaintiff did were ignored. He was eventually diagnosed with a ruptured tendon in his pinky. He also sustained swelling, nerve damage, and a tear in his right shoulder. Defendants ordered all occupants out of the vehicle and proceeded to search them and the vehicle. Defendants recovered no contraband from Plaintiff. Despite having no probable cause to believe that Plaintiff had committed any crimes or offenses, Defendants placed Plaintiff into handcuffs and under arrest. Defendants used excessive force in effectuating the arrest, namely by placing excessively tight handcuffs and refusing to provide Plaintiff with medical care despite Plaintiff's repeated requests. Plaintiff was subsequently transported to the police precinct where Defendants falsely informed employees of the New York District Attorney’s Office that they had observed Plaintiff commit various crimes and offenses when in fact Defendants did not observe Plaintiff violate any laws or ordinances. After attending all required Court appearances, all charges against Plaintiff were dismissed on or about November 22, 2021.
