Defendant Officers told Plaintiffs that they were responding to a noise complaint, to which Plaintiffs explained to Officers that they were not the source of the noise. After a verbal dispute about whether Plaintiffs had done anything wrong, the Officers told Plaintiffs that they were under arrest. After Plaintiff Estarlin Francisco questioned the Officers' actions, the Officers pepper sprayed Plaintiff Estarlin without justification and handcuffed him excessively tight. The officers then handcuffed Plaintiff Edwin excessively tight and punched his left hand about two times after Edwin stated that the handcuffs were too tight and that he previously had surgery to his left hand and had a metal plate in it. The officers then placed both Plaintiffs inside their patrol car and went to the 72nd Precinct. On the way to the precinct, Officer Cabral punched Edwin twice in the face after he questioned the Officers' actions. Shortly after entering the 72nd Precinct, Defendant Officer Cabral struck Plaintiff Estarlin in the head with his radio. While Plaintiffs were held in the Precinct, the Officers did not provide Plaintiffs with food, water, or a telephone call. The Officers held Plaintiff Estarlin tightly in handcuffed in a cell for several hours. While in custody, both Plaintiffs were treated by emergency technicians and Plaintiff Edwin was treated at Lutheran Medical Center. In the 72nd Precinct, the Defendant Officers falsely charged Plaintiffs with disorderly conduct, obstructing governmental administration, resisting arrest, and related offenses. Officer Maurio misrepresented to the Kings County DA's Office that Plaintiffs had committed various offenses. Officer Cabral encouraged prosecutors to file false criminal charges against Plaintiffs and signed and swore to the accuracy of a criminal court complaint falsely charging Plaintiffs with various offenses. Plaintiff was the guest of Andre Deluca. At approximately 11:40 p.m., plaintiff attempted to leave the room, at which point Officer Cabral did not permit Plaintiff to leave the room and instead forcefully entered Room 301 by pushing\nthe door open with his gun drawn, detaining Plaintiff. Cabral did not have and did not attempt to obtain a warrant. Upon unlawfully entering Room 301, Cabral shouted “freeze” to Mr. Morston, and ordered him to raise his hands in the air and “shut the fuck up and do as you’re told.” Plaintiff complied. Cabral then conducted a frisk of Plaintiff's person. Cabral did not find anything, but he continued the search and confiscated plaintiff's cell phone, credit cards, and NY State ID, as well as money from inside plaintiff's shoes. Cabral proceeded to handcuff Mr. Morston and removed him from Room 301 into the hallway ordering him to lie on the ground, which he did. In the hallway, Cabral interrogated Mr. Morston, asking if he “knew about anything illegal going on” in the hotel, to which Mr. Morston explained that he did not know about anything illegal and that he was there to pick up Andre Deluca to go out for food and entertainment. Cabral then performed a search of room 301. Cabral did not find any firearm from Mr. Morston, but he nonetheless arrested plaintiff on charges of weapons possession. Andre Deluca subsequently said that the weapon found was his. Cabral deliberately caused Mr. Morston's continued imprisonment despite no evidence that the firearm belonged to Morston.
