On that same day, Genco instituted a criminal proceeding against Plaintiff and Plaintiff was arraigned and then imprisoned in lieu of bail. Plaintiff was subsequently indicted by a grand jury. On or about December 6, 2013, a judge ruled that there was insufficient evidence to support the charges and released plaintiff on his own recognizance.
