Plaintiffs were heading towards the Lincoln Tunnel to return home to New Jersey. Defendant officers commanded plaintiff Augusto Perez to stop his vehicle. One of the officers told the plaintiff he was being stopped because he was not wearing a seatbelt. Plaintiff had in fact been wearing one. Officers then proceeded to open the doors to the vehicle and began to forcibly remove plaintiffs Augusto Perez, Ricardo Perez and Jhexon Cruz from the vehicle. Without probable cause, defendant officer handcuffed Augusto Perez. During the course of taking plaintiff into custody, one defendant officer punched plaintiff in the ribs. Plaintiff Lacotera was removed from the Honda for being a \"wise guy\". As officers took Plaintiff Lacotera into custody, they repeatedly punched him in the sides and back. Plaintiff Jhexon Cruz began to film the officer's misconduct with his cell phone. Defendant officer seized the cell phone and threw it to the ground, smashing it. Officers took the plaintiffs into custody. While in custody, an officer had taken hold of plaintiff Augusto Perez and struck his face on a gate, causing a laceration and bleeding. A blood sample that was taken more than two hours after the arrest from plaintiff Augusto Perez indicated a blood alcohol level of .113, he was charged with Driving while Intoxicated. Officers had filed false reports to support the arrest charges including disorderly conduct and/or obstruction of governmental administration. The charges against Plaintiffs Lacotera,  Ricardo Perez, and Cruz were dismissed either conditionally (ACD) or otherwise.
