Assailant's conduct was so threatening that one of plaintiff's neighbors came out of his apartment with a baseball bat. Several people called 911 and the NYPD dispatched defendant officers Ureiba and Garcia. When the police officers arrived they initially directed the assailant to step back, but upon learning of Plaintiff's gender identity their demeanor changed. Police officers refused to make a file a criminal complaint against the assailant who continued to threaten and harass the plaintiff in the presence of the police officers who did nothing but smirk. the Police officers only agreed to take a criminal complaint when the Assailant asked plaintiff's wife if she wanted to see his \"real dick\" and began to remove it from his pants. They did not arrest the assailant. \n\nOn May 15, 2015 plaintiff was granted a TRO directing the 28th precincts commanding officer to prepare accept and file a criminal complaint from the plaintiff. When plaintiff tried to present the TRO and file a criminal complaint, the police officers were mocking and refused to take the criminal complaint. \n\nOn May 18, 2015 Plaintiff's counsel informed the NYPD's agency attorney that Plaintiff would seek to hold the NYPD liable for contempt of the TRO. Only then did the NYPD send three nondefendant officers to the plaintiff's apartment to take a criminal complaint. \n\nOn May 19, 2015 plaintiff tried to obtain an Order of Protection against the assailant. He was told that the assailant had to be arrested in order for the judge to be able to grant the Order of Protection.
