Plaintiffs had parked their vehicle outside a deli. Plaintiff Mcintosh went inside the store and left Plaintiff Santiago sitting in the vehicle with their dog. Plaintiff McIntosh legally purchased a bottle of water in the deli and got back into his car. As Plaintiff McIntosh was re-entering the vehicle, one of the Defendant Officers approached the vehicle and said, “This car looks stolen, where is the documentation for it?” and\nthen called for backup on his radio. Plaintiff Mcintosh, confused because the car was legally his, asked Defendant Officer, “Why do you need the info for the car, it’s my car?” Defendant Officers, not liking the answer provided by Plaintiff McIntosh, opened the car door, and immediately tried to pull Plaintiff out of the car. No lawful order was given to exit the vehicle before Defendants ripped Plaintiff out of the vehicle. Defendant officers dragged Plaintiff Mcintosh out of his vehicle by his legs, banging his head on the frame in the process, and proceeded to throw him to the ground and slam his head onto the concrete. Plaintiff Santiago asked Defendant Officers why this was happening to her boyfriend, at which point she was also dragged out by the defendant officers and slammed up against the outside of the vehicle. Plaintiffs were unlawfully arrested and handcuffed by\nDefendant Officers without legal justification or probable cause. Both plaintiffs were subject to an illegal pat-down search by Defendant Officers. Both plaintiffs were then placed in the back of an NYPD vehicle and transported against their will to the 75th Precinct. While in custody at the 75th Precinct, Plaintiffs repeatedly requested professional medical treatment for their injuries as they were in severe pain, but they were repeatedly ignored by Defendant Officers. Defendant Police Officers falsely stated to the Kings County District Attorney’s Office that they were guilty of Resisting Arrest and Disorderly Conduct. After approximately 12 hours in custody, Plaintiff Santiago was released from custody at the 75th Precinct with a desk appearance ticket. Plaintiff McIntosh was transferred from the 75th Precinct to Kings County Central Bookings, where he was arraigned in front of a Judge on false charges and released on his own recognizance. Thereafter, both Plaintiffs were treated for the injuries inflicted upon them by Defendant Officers. Among other injuries, Plaintiff Santiago had a dislocated kneecap; Plaintiff Mcintosh’s leg had been pulled out of socket.
