The officers also failed to promptly summon the EMTs present at the residence after they noticed Ms. Francis had become unconscious, an act which also contributed to her death. Prior to the restraint, the officers had appeared at Ms. Francis's bedroom door without her having been notified. The officers were aware that Ms. Francis was mentally ill. In an attempt to conceal the wrongdoing of the subsequent restraint of Ms. Francis, the officers erroneously claim that their restraint was merely effected as self-defense against her aggressive behavior. Ms. Francis had in fact not been aggressive with the officers but had attempted to escape from strange men she did not recognize, because of delusion, as officers. In pursuit, the officers tackled Ms. Francis onto her mother's bed. There, all four rested their weight on top of Ms. Francis. In the course of a struggle, one officer was seen to strike Ms. Francis in the head at least six times by the decedent's sister. Another officer was overheard signaling to the others to tase Ms. Francis. And yet another was heard to curse at Ms. Francis while attempting to handcuff her. As a result of this abuse, Ms. Francis soon stopped moving. The family was immediately thereafter misled by the officers into believing Ms. Francis was still alive. Further, defendant NYPD Sergeant McKoy, supervisor of the four officers, filed a false report in which he noted that Ms. Francis died at the hospital, despite hospital staff noting that she died 90 minutes prior of cardiac and respiratory arrest -- i.e., she died while at the Francis' residence in police custody.
