Plaintiff Miller was six and a half months pregnant at that time.  \n\nPlaintiff Miller: Defendants Rosa, Rodriguez, Vega, Villavizar and Does 1-10 then violently grabbed and contorted plaintiff Miller’s arms behind her back and applied metal handcuff to her wrists in an excessively tight fashion.  Defendants Rosa, Rodriguez, Vega, Villavizar and Does 1-10 thereafter subjected plaintiff Miller to various assaults and batteries by physically restraining her, pulling her hair, striking her all about her body and head, slamming her to the ground, kneeing and kicking her back while her arms were handcuffed behind her back while plaintiff Miller was over 6 months and visibly pregnant.  Defendants then violently shoved plaintiff Miller’s stomach while she was pregnant, requiring her to be transported to a hospital via ambulance, where she was treated for ca. 6 hours, during which time she was handcuffed to a gurney.  She was then transported to a precinct by defendants Rosa, Rodriguez, Vega, Villavizar and Does 1-10, which engaged in the fabrication of evidence and forwarded false claims to prosecutors so that plaintiff Miller would be criminally prosecuted.  All charges were dismissed on or about August 22, 2019.\n\nPlaintiff Rivera:  Defendants Rosa, Rodriguez, Vega, Villavizar and Does 1-10 then violently grabbed and contorted plaintiff Rivera’s arms behind his back and applied metal handcuff to his wrists in an excessively tight fashion.  Plaintiff Rivera was subjected to various assaults and batteries by plaintiff, striking him all about\nhis body and head, slamming his head against a wall and restraining him. \n Defendants Rosa, Rodriguez, Vega, Villavizar and Does 1-10 then shoved plaintiff Rivera in the police car and transported him to a precinct, where he was fingerprinted, photographed and searched.  Defendants then fabricated evidence and forwarded their claims to prosecutors, namely Larceny, Second Degree of Harassment and Resisting Arrest, so that a criminal prosecution against plaintiff was initiated.
