NYPD officers from the 48th Precinct, including Officer Castaldo (Defendant), arrived and arrested the plaintiff despite protests she was not involved in the altercation. The Plaintiff was handcuffed, transported to the precinct, and upon questioning the basis for her arrest, informed she would only be issued a summons. However, shortly thereafter, she was re-arrested by the Defendant and placed in a cell. Approximately 12 hours later, the Plaintiff was released on her own recognizance on charges of criminal trespass, which were ultimately dismissed on May 2, 2018, after prolonged court proceedings.\n\nThe Plaintiff was falsely arrested, falsely imprisoned and suffered from both abuse of process and malicious prosecution without probable cause causing her significant psychological injuries, including emotional distress. The Defendants acted with malice and deliberated indifference to her Fourth and Fourteenth Amendment rights, ultimately resulting in severe and permanent psychological harm.\n\nThe City of NY (Defendant 2) was negligent in the hiring, supervision, and training of the Defendants involved, this systemic failure contributed to the unlawful arrest and violations of the Plaintiff rights.","documents":[{"url":"https://web.archive.org/save","type":"complaint"}]},{"name":"Ramos, Abigail vs City of New York, et al.","start_date":"2016-11-10","disposition_date":"2017-10-20","payout_amount":6000,"disposition":"Settlement","docket":"16CV07578","court":"U.S. District Court - Southern District NY","officer_name":"Castaldo, Pierluigi","summary":"The plaintiff was on the street having a verbal argument with a friend when the defendant officer approached and stated he needed to search them.
