Plaintiff wanted to make a formal complaint in person, but was told that he could not and he must leave. Plaintiff asked to speak with a supervisor, this is when he was surrounded by multiple police officers and was backed into a corner. Defendant Officers grabbed Plaintiff's wrists, arms, and waist, and slammed Plaintiff into the floor of the lobby. This is when Defendant Police Officers, including Police Officer Christopher Malzahn unlawfully detained and arrested Plaintiff without legal justification. Defendant officers also included Defendants Police Officer Christopher Malzahn, Ariel Mallol, Ashley Delia, and Sergeant Byan Ortiz. \n\n\nDefendants used excessive force by, amongst other things, yanking Plaintiff by the arms and torso, throwing Plaintiff to the ground, placing handcuffs upon Plaintiff’s wrists in an excessively and abusively tight manner, threatening the use of an electronic taser device despite the fact that Plaintiff was not resisting arrest and was already handcuffed, and suffer other injuries. Additionally, Defendant officer threatened to use a taser on Plaintiff. While Plaintiff was in custody, the Defendant Police Officers provided the Bronx County DA's Office with false, misleading, and/or incomplete information that Plaintiff committed a crime. Plaintiff was unlawfully detained for approximately 28 hours. They opened the door to defendants when their dog starting barking from inside the back of the residence. Plaintiff confirmed that the dog was secured, complied with Defendant’s order to step out of the apartment and to provide proof of residence. In order to show a proof of residence, the boyfriend asked to release the dog to enter the room and the police officers acknowledged. Quickly the dog went at the door, but the girl was able to stop the dog and controlled it, which represented no threat for them. However, defendants police officers Mallol and Hilario willfully engaged in the unreasonable use of force and unreasonable seizure by shooting Plaintiff’s dog nearly missing by only inched a 16 years old girl causing her serious emotional distress.
