She noticed several police officers, including the Defendants, dragging her brother toward the door. Plaintiff's brother was handcuffed and bleeding from the face. She showed the officers her identification and asked if she could take her brother's property before he was taken to the precinct. The officer agreed to release the property, specifically a cell phone which was in the brother's back pocket, and said he would get the property and give it to her. As Plaintiff took a step toward the elevators to await the property, another office stepped in, told her to get out of the area, and struck her on the head. Plaintiff fell into another witness in the lobby area. The officers then left the lobby. Upset about being struck for no reason, Plaintiff followed the officer outside and repeatedly asked for his badge. The officer didn't provide the requested information and instead placed the Plaintiff under arrest. Plaintiff was taken to the 81st Precinct and eventually to Brooklyn Central Booking and a complaint was filed against her alleging obstructing governmental administration and harassment. Thirty six hours after her arrest, Plaintiff was brought before the criminal court judge who dismissed the harassment charge as insufficient on its face and Plaintiff was released without bail.
