POs proceeded to stop, question, frisk, and search Plaintiff. PO Ryan walked to a nearby construction site, picked up a hammer that was laying there, and asked Plaintiff if the hammer belonged him. Thereafter POs placed Plaintiff under false arrest and transported him to the 7th Precinct. Sgt. Vincent Lee lied that Plaintiff smelled like marijuana to justify an unreasonably invasive strip search of Plaintiff in the bathroom. No contraband was found. Plaintiff was transported to Central Booking where he was arraigned on various false charges, including Possession of Burglar's Tools, based on POs' misleading evidence. Plaintiff was released after approximately 14 hours in wrongful custody. All charged against Plaintiff were dismissed on July 18, 2012. Ryan walked over to a nearby construction site, picked up a hammer, and asked plaintiff if the hammer belonged to him. Plaintiff responded the hammer did not belong to him and was probably part of the construction site. Defendant handcuffed plaintiff, placed him in a squad car, and transported him to the 7th Precinct. At the Precinct, he explained to the desk sergeant he was arrested unlawfully. The desk sergeant came from behind the desk and shot plaintiff in the back with a Taser gun. Defendants forced plaintiff into the bathroom, and strip-searched him. After 6 hours, plaintiff was transferred to Manhattan Central Booking. Defendants gave false information to the DA to induce the DA to file an accusatory statement against plaintiff. After 14 hours, plaintiff was arraigned.
