The plaintiff was left with swelling and bleeding to his face and mouth, as well as a cracked tooth. The plaintiff then spent hours complaining of pain and discomfort before being taken to Kings County Hospital for an x-ray, after which he was returned to the 67th Precinct. Plaintiff was denied medical aid and attention. \n\nDefendant Giambo, Defendant Hauswirth, and Defendant John Does 1-3 conveyed false information to prosecutors in order to have Plaintiff prosecuted for Criminal Possession of a Weapon in the Second Degree and other related charges. Defendant Giambo, Defendant Hauswirth, and Defendant John Does 1-3 prepared false sworn affidavits and false police reports relating to Plaintiff's arrest. Plaintiff was unlawfully held in police custody for 26 hours and was arraigned on false charges. Plaintiff's bail was set based on Defendant Giambo, Defendant Hauswirth, and Defendant John Does 1-3 false allegations and was thus unlawfully imprisoned additional time. Defendant Giambo and Defendant Hauswirth repeatedly gave false testimony at the grand jury, the pre-trial hearing and the trial in connection with the unlawful prosecution of Plaintiff.
