After, Police Officer Detective John P. SYLVESTRE arrived in a different vehicle, and approached Plaintiff's vehicle with his weapon drawn. They reached over Plaintiff's lap to unlatch his seatbelt and and forcefully removed Plaintiff from the vehicle and slammed him to the pavement. The Officers did not command Plaintiff to exit the vehicle.\n\nWhile Plaintiff was lying on the pavement, DET. SYLVESTRE and V1 OFFICER were kicking Plaintiff in the body, pressing Plaintiff's face into the pavement with their boots, and forcefully detaining him with handcuffs. Plaintiff and his car were illegally searched. They denied Plaintiff request for medical asistance to threat injuries from the collision. \n\nLater, Officer ARIAs and others arrived to the scene. After privately talking with DET. SYLVESTRE and V1, he arrested Plaintiff and transported him to 112 Precint. There, other OFFICERS  told Plaintiff \"he would be detained for three days if he continued to ask for medical treatment.\" Plaintiff was finally taken and discharged from the hospital, he remained unlawfully detained through the following morning.\n\nAt the Court, Plaintiff learned that he was being falsely charged with eight charges, including Resisting Arrest, Obstruction, and Fleeing Officer in Motor Vehicle, and Reckless Driving.\n\nPO ARIAS was the Arresting Officer, and he provided sworn deposition with false account of the circumstances\nsurrounding Plaintiff's arrest. Defendants failed to return to Plaintiff certain items of Plaintiff's personal property. Following the August 14, 2018 incident, members of the NYPD created a false MV-104 Police Accident Report.\n\nAll criminal charges filed against Plaintiff were thereafter dismissed.","documents":[{"url":"https://iapps.courts.state.ny.us/nyscef/ViewDocument?docIndex=pMLlNEqIyZJ0G49A1PAdeQ==","type":"complaint"}]}],"id":"RADZ","url":"https://www.50-a.org/officer/RADZ"}
