During the arrest, Marin suffered bruises from the handcuffs placed tightly on his wrists. Marin was released after a show-up identification was conducted at the site of the arrest with negative results. Upon hearing about the arrest, Marin’s mother (also a Plaintiff in the case), Garcia, went to the precinct and inquired about Marin’s arrest with PO Kang. Shortly after Garcia left the precinct and returned home, NYPD officers, including PO Kang, arrived at Garcia and Marin’s home and transported Garcia and Marin back to the precinct, where Marin was again arrested, handcuffed to a pole, and placed in a holding cell for several hours. Upon Marin’s release, he received a desk appearance ticket signed by PO Sime.
