Plaintiff showed the officers his injuries to show why getting out of the car would be difficult, but the officers still demanded he do so.  When plaintiff got out of the car, he picked up his jacket because he was cold.  The officers asked plaintiff to give them his jacket.  He wanted to put on the jacket and showed the officers that there was nothing inside it.  The officers then cuffed plaintiff and took him down to the ground.  P.O. Kyle Erickson searched vehicle, didn't find any contraband, and said to P.O. Elmer Pastran that he couldn't find anything but that they \"had to find something.\"  Then P.O. Erickson attempted to turn off his body camera and planted some marijuana in plaintiff's car.  The camera had not gone off and you can see in the video P.O. Erickson \"finding\" the marijuana.  The officers also discussed not giving the driver a summons because she was \"very cooperative\" but that they \"should\" because of the \"whole situation\" (namely, that they had illegally searched the vehicle, arrested plaintiff, and planted the marijuana).  The officers had stored the marijuana, florets of which can be seen on the floor of their vehicle when they returned to it, before turning off their body cams.  \n\nPlaintiff was placed on supervised release as a result of the false charges against him.  Plaintiff intended to reject the plea deal offered to him because of his innocence.  Plaintiff could not afford the bail set for him so he had to spend three days in jail for a crime he didn't commit.  He decided he wanted to plea rather than go to Rikers.  In June 2020, with the benefit of exculpatory body cam footage, plaintiff moved to vacate his conviction, which was granted on October 29, 2021.
