Defendants kicked and banged on Plaintiffs' entrance gate. When Gill opened his door, he was told by Defendants to \"Open up!!, what are you doing in there?\" Plaintiff replied that nobody had called the police. Defendants replied that Plaintiffs were not supposed to be there. Plaintiff responded that he had a right to be there because it was his grandfather's house, and then left. Defendants repeated their demands, further adding that they would call the Fire Dept to break the door down. Plaintiffs went back upstairs, and shortly after heard a loud crack: the Defendants had broken the front gate hinge. \nOn or around December 12, 2014, four Plainclothes officers surrounded Plaintiffs at their front door, alleging that they had spoken to the owner of the home and that Plaintiffs were not supposed to be there. Plaintiff again said that this was his grandfather's home. \nOn March 2, 2015, Chaim and Khan broke into Plaintiffs' home and attempted to forcibly usher plaintiff Whitley outside of her home. Chaim alleged that this was his home and said he was calling the police. Officers Agard and Dawkins arrived. When Gill attempted to block his doorway, the officers twisted his arm, aggravating a pre-existing back injury. Gill was then pushed into a wall and handcuffed by Agard. Dawkins, Khan, and Chaim then walked around the home, taking photos. When Whitley protested the invasion of her privacy, she was told by Agard to \"shut up and stay in that room, it's their house!,\" threatening prison. \nWhile being held outside, Defendant Dawkins asked again whose house this was. Gill again replied that this was his home. Dawkins then asked for Gill's identification, and Gill refused. Dawkins replied that this refusal would amount to another charge against him before putting him in a squad car. Officers Fox and Grandstaff then evicted Whitley from her home. Gill was charged with possession of a weapon, menacing, false personation, and criminal trespass on his home and property. The unauthorized arrest was approved by Sargent Haug and Sargent Pham. \nWhitley goes back to her home after visiting Gill in jail. Moments after she gets back, Whitley witnesses Bazlime, Khan, and Chaim lock the gate and board the front door entrance. Whitley remained locked inside her home until Gill was released from jail and able to open the door with a chain cutter. \nWhen Gil asked if he could file a report for trespassing and harassment, Agard replied that he could not because \"[the Jewish people] have rights and you don't. Plaintiff was arrested without cause. Defendant officers transported Plaintiff to the 73rd Precinct. At the precinct, Plaintiff experienced chest pains. Plaintiff requested to be transported to the hospital for medical treatment. Later, EMS personnel arrived at the precinct. Defendant officers stated there was nothing wrong with Plaintiff, and insisted Plaintiff must be evaluated and treated at the precinct and should not be transported to the hospital for medical evaluation. EMS personnel advised defendant officers they could not treat Plaintiff at the precinct and Plaintiff must be transported to the hospital for medical treatment. Afterwards, defendant officers forcibly punched Plaintiff on his right shoulder knocking him down to the floor, with the handcuffs pressed against his back. Defendant officers yanked Plaintiff off the floor grabbing him by his waist and forcibly dragged him to the ambulance. At the ambulance, defendant officers opened the door, forcibly dragged Plaintiff up the stairs and threw Plaintiff inside the ambulance.  Plaintiff sustained serious injuries on various parts of his body as a result of the assault by defendant officers, and was transported to Brookdale Medical Center. After detaining Plaintiff for a lengthy period of time at the hospital and precinct, Plaintiff was transported to Central Booking for arraignment. Defendant officers met with prosecutors employed by the Kings County DA’s Office, and falsely stated to the prosecutors, that Plaintiff committed the charged offenses. Based on defendant's false testimony, a prosecution was commenced against plaintiff. On April 23, 2013, Plaintiff's case was adjourned in contemplation of dismissal.
