Prior to being approached by the defendants, the plaintiff in the vicinity of an alteration where he was shot four times. An ambulance arrived to treat the plaintiff's injuries. Then, the defendants, The City of New York, NYPD Officer Colin Higgins, and other unnamed NYPD Officers John Doe I - V, approached the plaintiff with loaded firearms, outstretched limbs, and other objects that placed the plaintiff in imminent fear of serious physical contact. The defendants proceeded to seize and arrest the plaintiff without a warrant or any other legal justification. The defendants effectuated this unlawful stop and search in an excessive manner by committing multiple batteries against the plaintiff. The plaintiff was taken to St. Barnabas Hospital in the Bronx to have his injuries treated. Afterwards, the defendants transported the plaintiff to a police station and / or a correctional facility in the Bronx where he was charged with several crimes and held in custody for 7 days. While in custody at the correctional facility, the plaintiff was subjected to excessive force and unlawful searches by the defendants. The plaintiff was subject to several strip searches, cavity inspections, was unable to use his asthma pump, and handcuffed so tight his wrists turned red. \n\nBetween June 1, 2017 and July 3, 2017, the defendants maliciously prosecuted the plaintiff by charging him with crimes which were not supported by any probable cause. The defendants deliberately provided false information to the District Attorney's office regarding the plaintiff's alleged criminal activity.
