They purposefully and maliciously misled the Special Narcotics Prosecutor to prosecute in order to justify the arrest made on June 6, 2012. Based on false information provided by the officers, the Office of the Special Narcotics Prosecutor initiated a prosecution against Plaintiff on June 19, 2012. After 24 hours in police custody, Plaintiff was arraigned and falsely charged with several crimes. Plaintiff was unlawfully detained until July 2, 2012. They also searched the car and allegedly found a plastic bag containing marijuana on the drivers side. The defendants arrested the entire group and took them to the 73rd Precinct.  Forrester arrested the plaintiff with possession of marijuana , even though no marijuana was found on or near him.  The Kings District Attorney's Office decided that they were going to decline prosecution of every member of the group except for the person who was driving which was plaintiff's brother Louinis.  Confusing plaintiff with his brother, the DA Office decided to prosecute plaintiff as the alleged driver and declined prosecution of the other four individuals.
