At no time relevant herein did the defendant police officers recover any illegal drugs, weapons or contraband from plaintiff’s possession, custody, or control. At no time relevant herein did the defendant police officers have probable cause. The defendants were targeting another passenger in the vehicle who plaintiff had not met before. Drugs were recovered from this other passenger and he confirmed to the officers they belonged to him only and nobody else in the vehicle had knowledge of them. Plaintiff was subsequently transported to the 109th precint, and after that to central bookings. He was arraigned approximately 24 hours after his arrest. Plaintiff was maliciously prosecuted and the defendants provided false and misleading evidence to the DA office. Plaintiff had to appear in court about 20 times before all charges were dropped on February 26, 2020. Those officers that did not physically touch\nplaintiff but observed their fellow officers violating plaintiff's rights but neglected to intervene to stop their fellow officers from continuing to violate plaintiff's rights are liable to plaintiff for their failure to intervene.
