Plaintiff had his phone out and was filming the police. Without any warning, PO Demery, Marquez, and Doe 1, directed by DI Lewis, ran towards plaintiff and tackled him from behind, causing plaintiff to land face first on the concrete, causing scrapes and abrasions on plaintiff right hand, cuts on the back of plaintiff’s left calf, and scrapes on plaintiff’s right shoulder, among other injuries. PO’s Demery, Marquez, and/or Defendant Doe 1 applied extremely tight handcuffs to plaintiff’s wrists. PO’s Demery, Marquez, Doe 1, and Doe 2 refused to remove or loosen the cuffs despite several complaints about the excessive tightness. Eventually, PO Demery removed plaintiff’s handcuffs and applied a different pair of extremely tight handcuffs instead. Defendants Does 3-5 took plaintiff’s bicycle and did not return it. Plaintiff was then taken to New York Police Department headquarters and was released the next morning after a summons was issued. On September 29, 2020, the charges against plaintiff were dismissed on grounds consistent with his innocence.\n\nPlaintiff Kyala Schenck\nOn May 30, 2020 at or about between 11:00 p.m., plaintiff was lawfully present at a protest in Brooklyn. Without warning or justification, members of the NYPD began running at plaintiff and other protesters.  Plaintiff attempted to leave the area and return home. Nonetheless the PO’s directed by DI Lewis, assaulted and arrested plaintiff. PO 11-13,  including PO Michael Haber,  pushed plaintiff and forcefully grabbed her. PO Doe 11 shouted “put your hands behind your back” and shoved plaintiff to the ground. PO Doe 12 forced plaintiff’s head to the sidewalk and pinned her down, smacking her knee against cement. PO Doe 13 put his knee into the back of plaintiff’s neck and back. PO Does 11-13 pushed plaintiff against a storefront metal door gate and slammed her head to the ground and a metal gate. At least one of PO Does 11-13 struck plaintiff with a baton. At least one of PO Does 11-13 placed plaintiff in metal handcuffs. At least one of Does 11-13 replaced plaintiff’s metal handcuffs with extremely tight plastic handcuffs, along with an additional NYPD Doe Officer. Plaintiff was brought to Police headquarters. The next day PO Hussain issued plaintiff a Desk Appearance Ticket with Arrest Number K20619506 and released plaintiff from custody.
