Plaintiff recorded the encounter on video. When the officers passed Plaintiff, they exchanged words with Plaintiff. Defendants grabbed Plaintiff and his video camera and handcuffed and arrested the plaintiff and brought him to the PSA 7 precinct. \n\nPlaintiff, who was known for exposing police conduct through his role in CopWatch Patrol, was recognized when he was brought to the precinct and officers cheered at his arrest. Plaintiff was searched and his property removed. One Defendant classified Plaintiff's two way radio as a police scanner and relied upon the false classification to allege Plaintiff was guilty of a felony. Although Plaintiff's attorney arrived, Officers ignored the attorney and attempted to question Plaintiff without his lawyer present. Plaintiff heard and recorded officers acknowledging that Plaintiff never got within 15-20 feet of them while recording Defendants interacting with the two civilians yet determining they would still charge Plaintiff with interference. \n\nDefendants did not issue a desk appearance ticket and instead kept plaintiff in custody for approximately 24 hours. At 9pm on August 6, Plaintiff was released from custody without explanation or charges. But that same night, Defendants rearrested Plaintiff after making false statements to secure charges against Plaintiff. Plaintiff received notice that Defendants were attempting to unlock his phone despite Defendants not having a warrant. When Plaintiff received his belonging back including his recording equipment, Defendants had removed memory cards and erased all memory and recordings. \n\nOn January 12, 2017, all charges were dismissed against Plaintiff by application of the Bronx District Attorneys Office.","documents":[{"url":"https://iapps.courts.state.ny.us/nyscef/ViewDocument?docIndex=bW0S7wgplc1TNq3DGY7TLg==","type":"complaint"}]},{"name":"Franzone, Georgette, et al. vs City of New York, et al.","start_date":"2014-01-06","disposition_date":"2015-04-09","payout_amount":0,"disposition":"Zero Disposition","docket":"13CV05282","court":"U.S. District Court - Eastern District NY","officer_name":"Tejera, Juan M.","summary":"On or about September 23, 2009, NYPD officers got involved in a criminal scheme, which a co-defendant had initiated against her business partner, Plaintiff 1, and three legal entities, Plaintiffs 2-4, with which Plaintiff 1 was associated. The scheme involved fraud, embezzlement, conversion, and other criminal activities. Active or retired NYPD officers – Farije Tonuzi-Sheridan, Juan Tejera, James Grant, Ann Guerin, Hanna Tonuzi Alvarez, Frank Alvarez, Joseph Trischitta, Marco Venezia, and William Masso – assisted in the scheme by committing various unlawful acts. \n\nAbout September 23, 2009, co-conspirators contacted former NYPD officer Farije Tonuzi-Sheridan, who they knew, concerning the criminal scheme. Tonuzi-Sheridan agreed to use her former position as a NYPD officer to further the criminal activities, and contacted active NYPD officers for that purpose. The active NYPD officers agreed to use their police powers to further the scheme. The police officers then assisted in the illegal seizure of assets from Plaintiffs and in, inter alia, locking Plaintiff 1 out of the business premises. The police also falsely alleged, during a phone call with Plaintiff 1, that the police were in possession of a court order authorizing the seizure of the premises, and threatened her that if she were to reenter the premises, she would be arrested. For several weeks around September 30, 2009, POs provided “around-the-clock security” to ensure that if Plaintiff 1 were to seek to regain possession of the premises, the police would restrain her. Subsequently, PO Juan Tejera, acting on the request of his former NYPD colleague Tonuzi-Sheridan, presented false testimony to a court and then, on April 23, 2010, he and PO Ann Guerin executed a false arrest of Plaintiff 1. Plaintiff 1 spent over 30 hours in custody, without charges ever being filed.
