POs kept Plaintiff in custody for approximately 18 hours in various over-crowded cells. Plaintiff retained private defense counsel at a personal cost of $2,500. Other POs present were or should have been aware Plaintiff did not commit the crime but did not intervene. Later that day, after investigating the District Attorney declined to prosecute because it determined no crime had been committed. However, Plaintiff remained in custody for several more hours until the POs permitted Plaintiff's release.
