The police were looking for two men who had sexually assaulted a woman the month prior. The officers said they were looking for \"Daniel Logan\". Plaintiff's mother said she does not know a \"Daniel Logan\" and there was no one by that name there. The officers demanded entry. Plaintiff told them his name and without probable cause, the officers arrested Plaintiff and put him in a police van. \n\nOnce at the precinct, Plaintiff was interrogated by PO Quinones.\nPO Quinones and another PO berated, threatened, and frightened Plaintiff. One officer said she didn't think Plaintiff committed the crime. Eventually, Plaintiff made a written statement, not a confession, which was inaccurate and molded by the demands and threats of PO Quinones. The victim failed to identify Plaintiff as her alleged attacker during a police-arranged identification procedure. A surveillance video in the possession of the defendant officers of the alleged attacker walking down the street near the time of the incident bears no resemblance to Plaintiff.\n\nRegardless, PO Quinones caused Plaintiff to be prosecuted. Plaintiff was sent to Rikers Island. Five days after his arrest, DNA test results exonerated Plaintiff of the crime. He was released from jail. Detective Quiñones discovered that Mr. Samuels was in a rehabilitation facility, unable to speak or walk for the past two years. Detective Quiñones did not prepare documents about the investigation into Mr. Samuels or disclose L.G.’s identification of Mr. Samuels for eleven months, withholding the information from the Grand Jury. \n\nOn December 11, 2012, L.G. was shown a second “set book” to identify the perpetrator and selected Plaintiff. Detective Quiñones allegedly conducted another photo array with L.G. on January 10, 2013, in which L.G. once again selected Plaintiff. On February 5, 2013, Detective Quiñones arrested and questioned Plaintiff for two days in an interrogation room. Plaintiff was sent to Rikers Island on charges of rape and related charges without bail and remained there for one year, one month, and twenty-six days. Plaintiff was released on April 1, 2014. \n\nAfter a hearing before the New York State Supreme Court, Justice Cyrulnik held that Detective Quiñones’s photographic array and lineup procedures were unduly suggestive and violated Plaintiff’s due process rights.
