On July 1, 2022, the prosecution terminated favorably for Breton when a jury returned a verdict of not guilty. He was taken to the 46th Precinct, then to Central Booking, and was arraigned on charges of Criminal Possession of a Weapon and other related charges. Plaintiff remained in custody for over seven months until the US Attorney for the SDNY filed a Nolle Prosequi on October 26, 2018 and the Bronx County DA's Office dismissed the charged on October 31, 2018.
