After obtaining a search warrant, the officers opened the package and claimed to observe about fifteen pounds of marijuana. The Office of the Bronx District Attorney informed the officers that they lacked probable cause to arrest Plaintiff, as there was no information connecting Plaintiff to the package other than his name being on the box. Despite being on notice that they lacked probable cause, the officers proceeded to arrest Plaintiff. \n\nOn or about March 14, 2020 at approximately 4:00PM in the vicinity of 860 Hunts Point Avenue, Apartment 2D, Bronx, NY, Officer Rodriguez and/or the other officers, dressed as FedEx workers, arrived at Plaintiff's apartment, where he was not engaged in any illegal conduct. When Plaintiff answered the door, the officers told him they were delivering a package. When Plaintiff went to pick up the package from the hallway floor, the officers handcuffed and arrested him. The package was empty and contained no contents.
