They visited \"It'Sugar\" on Surf and Stillwell Avenues where they purchased some candies. Plaintiff and his friend were walking in the area of Mermaid Avenue and West 24th Street when they were approached by Defendant Officers Taylor and Calderon who detained, searched, and handcuffed them. The officers repeatedly searched the Plaintiff, but found only candy. Plaintiff was then arrested and charged with Criminal Possession of a Controlled Substance in the Third Degree. The Criminal Court Complaint was sworn out by Defendant Taylor who deposed that he had recovered a quantity of methamphetamine from the Plaintiff and that he (Officer Taylor) had training in the identification of methamphetamine. Plaintiff was arraigned on June 21, 2013 in Kings County Criminal Court. He had been in custody for over 24 hours when he was released on his own recognizance. The case was adjourned until September 19, 2013 for conversion of the accusatory instrument and the prosecution was ordered to obtain laboratory analysis of the alleged controlled substance. On June 22, 2013, the New York City Police Department Controlled Substance Analysis Section performed a Gas Chromatography/Mass Spectrometry analysis of the alleged methamphetamine.
