The officers ordered plaintiff to leave the premises, and plaintiff motioned to his two children to come with him to leave when defendant NYPD officer Jacob Newman and unidentified NYPD officers began striking and hitting plaintiff in the body, causing him severe injuries including cuts and lacerations. Plaintiff was then arrested and handcuffed. Plaintiff was then brought into the basement of Club Palenque, where he was again struck by an unidentified NYPD officer in the body, before being dragged from the basement to an NYPD patrol car, taken to the 46th Precinct in the Bronx, and thrown onto the sidewalk face up in front of the precinct building. Plaintiff was then again struck in and around the body at the 46th Precinct, causing profuse bleeding, and was dragged into the precinct bathroom and left unconscious on the bathroom floor. Plaintiff was told by defendant Newman not to inform two paramedics who arrived to treat him that he had been assaulted by defendant Newman, and plaintiff was then transported to St. Barnabas Hospital in the Bronx.\n\nPlaintiff was treated at the hospital for 12 hours, then taken back to the precinct, fingerprinted by defendant Newman, and then taken to Bronx Central Booking. Defendant Newman and other unidentified NYPD officers allegedly prepared false police reports, including a complaint charging plaintiff with disorderly conduct, resisting arrest, and obstructing governmental administration. The taxi was pulled over by an unmarked car operated by officer's Urbanek and Santiago.  Plaintiffs were not committing nay crime at this time , simply passengers in a taxi. The officer's approached the taxi to speak with the passengers.  Urbanek approached the side of the taxi where Julian Rivera was seated and opened the door.  Urbanek ordered Rivera out of the taxi . According to the sworn testimony of P.O. Urbanek, Rivera exited the vehicle , he reached into his pocket and retrieved a pistol, which he threw on the seat of the vehicle.  The pistol was recovered from the seat of the vehicle by Officer Santiago.  According to testimony from Santiago , during this time plaintiffs were sitting in the vehicle with their hands in their laps\" Plaintiffs were dragged out of the vehicle and slammed to the ground and beaten . At no time during this incident did plaintiffs commit any crime.  Despite these facts plaintiffs were arrested and charged with Criminal Possession of a Weapon in the Second Degree.  Plaintiffs both spent over 24 hours in custody .
