Indeed, the Defendants affirmatively knew that Mr. Figueroa had not committed any crimes or offenses, but they arrested him notwithstanding.\n\nMoreover, the Defendants Rivera, Dejesus, Slockbower, and the Doe falsely informed employees of the Bronx County District Attorney’s Office (“DA’s Office”) that Mr. Figueroa had committed various crimes/offenses. Such allegations were false, and the Defendants knew them to be false at the time they made the allegations. While in NYPD custody, Mr. Figueroa suffered from medical distress. The Defendants ignored Mr. Figueroa’s medical complaints and were otherwise deliberately indifferent to his medical needs and safety, causing him to\nsustain injury. Mr. Figueroa’s criminal charges were dismissed in their entirety on or about January 10, 2019. Plaintiff was approached by plain clothes officers who told him that he needed to get off the train.   Plaintiff indicated he was on his way to work.  The three officers suddenly threw Plaintiff across the car against the seats on the other side, then kneeled on his back.  Plaintiff experienced severe pain, was handcuffed, and was removed at the next station.  Plaintiff had a shoulder disability that was aggravated by the handcuffing and rough handling, but the officers did nothing.   After Plaintiff was taken to a facility, he was moved to a hospital.  Plaintiff was treated and returned to a holding cell, where he remained for over 24 hours before being arraigned for disorderly conduct and resisting arrest.  Defendant Officer Thomas Slockblower filed the false charges.
