On May 17, 2021, Plaintiffs had a business dispute with their partners, and the partners changed the locks to prevent Plaintiffs from entering. Plaintiffs went to the NYPD and met with NYPD Sergeant Jaspreet Gill who told the Plaintiffs that the dispute was civil and NYPD would not intervene, and advised them that they could call a locksmith to have the store's locks changed back. Plaintiffs returned to the store, causing their business partners to call the police. NYPD responded and determined Plaintiffs were lawful co-owners and there was nothing unlawful about their presence there. NYPD facilitated Plaintiffs' removal of that inventory from the Store. On May 18, 2021, Plaintiffs returned to the store with a locksmith who let them into the store to continue removing inventory. At 8:30 a.m. defendant officers Michael Ippolito, Lauren Creighton, Sean Little, Michael Powers, and John Doe arrived on the scene and confronted Plaintiffs, accusing them of breaking into the store and stealing merchandise. Despite explaining the preceding events, defendant officers ignored Plaintiffs and seized Plaintiffs, arresting and handcuffing them, and charging them with Burglary, Grand Larceny, and Criminal Possession of Stolen Property. Plaintiffs were transferred to the precinct. Defendant Officer Michael Powers excluded all information from his police report pertaining to the Plaintiffs' prior interaction with and direction from Sergeant Gill to use a locksmith and remove merchandise from the store. Plaintiffs were arraigned on the charges and released approximately 26 hours after their arrest, and were prosecuted over the course of the next four months.
