She did so and found her son pushed against a police car, surrounded by approximately five Police Officers. She repeatedly asked them what was going on, but they replied that she had to wait without providing any other information. The Police Officers then handcuffed her son, and one of them punched him in the face and side, and kneed him. The Plaintiff repeatedly asked why they were arresting her son, pleading with them to stop because he was only 16, but nobody listened to her. Instead, one of the Defendants pushed her and told her to move away. She complied, moving from the street to the sidewalk. The Defendants then started hitting her son. The Plaintiff asked them to stop, repeating that her son was only a child. They replied with profanities (“I don’t give a fuck”/“back the fuck up”) and threatened the Plaintiff that if she didn’t stop, they would arrest her. The Plaintiff complied with their request. The Plaintiff’s son was taken to the precinct by the police car. The Plaintiff went to the precinct as well, along with her son’s girlfriend and a relative. She asked to speak with the Defendant Forbes and/or another Defendant, but while she was waiting for them, she was arrested and tightly handcuffed. The Plaintiff told multiple officers that handcuffs were too tight, causing bruises, but they refused to loosen or adjust them. She was arrested for ‘resisting arrest’ although no officers had previously trying to arrest her, and she had never resisted. During the arrest, Defendants refused to provide Plaintiff with sufficient food, water, or medication, despite being aware that she suffered from diabetes and high blood pressure. As a result, she felt unwell and was taken to the hospital, where she remained for three hours. The Defendants fabricated false allegations and forwarded such information to the District Attorney Office. As a result, the Plaintiff was falsely charged with the crimes of resisting arrest, obstruction of governmental administration, assault, and harassment, although there was no physical or other reliable evidence that she had committed any crime. Defendants purported that Plaintiff Fraser committed trespass when Plaintiff entered lawfully with his friend, Robert, who resided in the apartment and had a key. Prior to his arrest, Plaintiff Fraser explained to defendant officers that he was an authorized guest in the building and his friend Robert had gone to the store and would return shortly, but officers would not wait for him to return. Defendants simply cuffed Plaintiff, along with six other individuals, and transferred them to a local precinct. Defendant officers never found any evidence indicating Plaintiff Fraser had knowingly and unlawfully entered the premises. They never attempted to verify Plaintiff Fraser’s statements of his lawful entry to the apartment. During the arrest, Defendants committed excessive force against Plaintiff by maliciously,\ngratuitously, and unnecessary placing excessively tight handcuffs on Plaintiff’s wrists. Plaintiff was physically injured as a result of the excessive use of force, and suffered scraping and marks to his wrist.
