Plaintiff began to complain to staff regarding his mother's perceived inadequate care. Staff called security and Plaintiff and his friend attempted to leave the hospital but security prevented the friend from leaving. Plaintiff left the hospital and was walking to his vehicle when he was approached by PO Christopher Keegan and PO Anthony Porcelli. Plaintiff began to walk away from them in an attempt to avoid a confrontation but POs attempted to grab him. Plaintiff pulled away and demanded to know why he was being accosted. In reply, POs grabbed Plaintiff and pulled his arms back while attempting to trip and drag him to the ground. POs tased Plaintiff twice, causing his body to go limp from the pain. Plaintiff was handcuffed and placed in a police vehicle. The high outside temperatures and the fact that the windows were closed led to Plaintiff having difficulty breathing, and after several complaints a window was ultimately lowered. Plaintiff was taken to a precinct then Central Booking where he was arraigned on charges. Plaintiff was compelled to return to court twice to defend against the false charges until all charges were dismissed on December 5, 2023. Plaintiff protested that the officers were acting overly aggressive for a minor offense. Officer Pruden became enraged and Plaintiff decided to leave the scene and walk towards his car. Officer Pruden decided to follow him to his car and walked into his car door as it was being opened. Officer Pruden falsely claimed that Plaintiff intentionally struck him with the car door and then began assaulting, battering, and using excessive force against Plaintiff. Officer Porcelli observed and did not intervene. Officers Pruden and Porcelli also intentionally loosened their body cameras to avoid videotaping.\n\nOfficers Jonathan Miranda and Jerry Sukhnandan arrived at the scene and did not intervene. Defendants detained Plaintiff's vehicle and illegally searched it.
