Strachn was swiping into the number 4 train station on River Avenue and 167th street in the Bronx, when he was recognized by NYPD Transit Officer Gomez, who had previously arrested plaintiff and was accompanied by his superior, Lieutenant Edwards. Plaintiff walked by defendant Gomez and told him that he would see him at the next court date, referring to plaintiff's prior arrest. Plaintiff walked up an adjacent set of stairs and walked back down after being ordered to return by defendant Gomez, who twisted plaintiff's arm behind his back violently. Defendant Edwards ordered defendant Gomez to let go of plaintiff's arm, which he did, but defendant Gomez then handcuffed plaintiff and put him in the back of a police car without Mirandizing him. Plaintiff was then brought to the 161st Station Transit Division Headquarters for booking, where he was searched, photographed, and fingerprinted by NYPD Transit Officer Frias Railyng. Plaintiff was informed at the Transit Police station that he would be charged with disorderly conduct before being held in a holding cell for four hours, then handcuffed, shackled, and brought to 100 Center Street Criminal Court in Manhattan.
