Defendant-officers, including Officer Christian Garcia (Shield No. 4233), pulled plaintiff over on an erroneous claim of turning in a bus lane. Defendant-officers' initiated said stop on account of plaintiff's protected status as an African American Male. Plaintiff provided defendants his ID and vehicle registration. Defendant-officers returned and requested plaintiff, his son, and mother of his son to step out of the vehicle. Plaintiff complied. In retaliation to plaintiff's polite request for an explanation as to defendants' actions, defendants placed plaintiff under arrest without probable cause, violently contorted plaintiff's arms, placed plaintiff in excessively tight handcuffs, and ignored plaintiff's requests to loosen aforementioned handcuffs. Defendant-officers proceeded to conduct an unlawful search of plaintiff's vehicle.\n\nUpon arriving at the 84th Precinct, plaintiff requested his attorney. Defendant officers, including Officer Garcia, ignored plaintiff's requests. Defendants, including Officer Garcia, then interrogated plaintiff, in violation of his Miranda Rights. Plaintiff was processed, transported to central booking, and detained. On January 1, 2021, plaintiff was released from custody. Defendant-officers signed criminal complaints against the plaintiff, in which defendants, including Officer Garcia, knowingly affirmed the truth of fabricated allegations against the plaintiff. Defendant-officers' statements were the basis of supporting criminal charges, including criminal trespass with the intent to damage property.
